1. About These Terms

These Terms and Conditions set out the basis on which Sombat Counsel (“we”, “us”, “our”) provides legal guidance and services to clients and website visitors. Please read them carefully.

By engaging our services, submitting an enquiry through our website, or continuing to use this website, you accept these terms. If there is anything here you are uncertain about, we welcome you to contact us before proceeding.

We may update these terms from time to time. The current version is always available on this page, identified by the date above.

2. Our Services

Sombat Counsel provides legal services relating to inheritance matters, estate planning, and estate settlement in Thailand. Our three service areas are:

• Wishes and Planning Talk — an initial conversation covering your wishes, family circumstances, and the preparation of a will or estate arrangement. This service is priced at ฿1,700.
• Estate Settlement Support — patient guidance through the documentation and procedural steps involved in settling an estate following a bereavement. Priced at ฿5,200.
• Inheritance Matter Representation — considered representation in inheritance matters requiring preparation, documentation, and the presentation of your interests. Priced at ฿9,400.

Service fees are confirmed in writing at the outset of an engagement. Additional disbursements (such as court filing fees or notarisation costs) may apply and will always be discussed with you in advance.

3. Client Engagement

A formal engagement begins when we have exchanged written confirmation of the scope of work and fees, and any required documentation has been completed. Prior to that point, any information shared with us is treated with confidence but does not constitute a formal legal engagement.

We work with one client or household at a time on each matter, to avoid any conflict of interest. We will inform you promptly if a conflict arises and cannot be resolved.

4. Fees and Payment

Fees for each service are as set out above and confirmed in writing before work begins. Payment terms are as follows:

• Payment for the Wishes and Planning Talk is due at the time of the appointment.
• For Estate Settlement Support and Inheritance Matter Representation, an initial portion is payable upon engagement, with the remainder invoiced as work progresses or at conclusion — the schedule will be specified in your engagement letter.

Fees are quoted inclusive of applicable Thai VAT unless otherwise stated. Invoices are payable within 14 days of issue.

We do not charge for brief follow-up queries within a reasonable period after a matter has concluded. Substantive new work is treated as a separate engagement.

5. Confidentiality

We hold all information you share with us in strict confidence, consistent with our obligations as legal practitioners in Thailand. Information relating to your matter will not be disclosed to any third party without your consent, except where required by law or necessary to carry out your instructions (for example, corresponding with a court or government office on your behalf).

Our confidentiality obligations continue after an engagement has concluded.

6. Our Responsibilities

We will:

• Approach your matter with care, diligence, and honesty.
• Communicate clearly and in terms you can follow, avoiding unnecessary legal language where possible.
• Keep you informed of progress and of anything that may affect your matter.
• Act only within the scope of instructions you have given us.

We do not provide tax, financial, or investment advice. Where such matters are relevant to your situation, we will say so and suggest you seek appropriate specialist guidance.

7. Your Responsibilities

To allow us to assist you properly, we ask that you:

• Provide accurate and complete information when requested.
• Inform us promptly if circumstances relevant to your matter change.
• Respond to our communications within a reasonable time.
• Pay invoices as agreed.

We are not liable for delays or difficulties arising from incomplete, inaccurate, or late information provided by you.

8. Limitation of Liability

We take our work seriously and aim to give you sound, careful guidance. However, legal outcomes depend on many factors outside our control, including court decisions, the conduct of other parties, and changes in law or regulation.

Our liability to you in connection with any matter is limited to the fees paid for that matter, except in cases of fraud or wilful misconduct on our part. Nothing in these terms limits liability in a way that is not permitted under applicable Thai law.

9. Termination of Engagement

You may end our engagement at any time by notifying us in writing. You will be responsible for fees incurred up to the date of termination.

We may also bring an engagement to a close in certain circumstances, including non-payment of fees, a breakdown of trust, or a conflict of interest that cannot be resolved. We will give reasonable notice and, where possible, support a smooth handover.

10. Intellectual Property

Documents, letters, and written advice prepared by us in connection with your matter are provided for your personal use in that matter. They may not be reproduced or relied upon by third parties without our prior agreement.
